Personally identifiable information refers to any information that can be used to identify you as an individual in any way. Enrollment in the eCreditCare service is contingent upon your agreeing to the terms and conditions of membership and providing basic registration information, including: full name, date of birth, email and physical address and telephone number. In addition, we collect information so that we can provide the eCreditCare service, such as your social security number and credit card information. Your social security number and credit card information, as well as specific account information from your credit report, is never provided to any third party without your express consent. Your social security and credit card information are used for the sole purpose of providing the eCreditCare service. Therefore, for purposes of this description of our privacy policy, your social security number and credit card information are considered restricted personally identifiable information and are absolutely confidential. Any other information requested of you during your participation in the service is optional. |

ECreditCare does not provide any of your personally identifiable information to advertisers. Your personally identifiable information will not be given to any third-party advertiser. If you respond to a communication to take advantage of an offer you may receive, you may specifically make the choice to share your personally identifiable information. |
Automatically collected information |

When you log on to the eCreditCare website, the server may automatically recognize you by an encrypted member key, also referred to as a "cookie." this cookie acts as a unique identifier. We may use third party cookies and clear pixel gif files (also referred to as "web beacons") to measure page views and email responses. These devices allow eCreditCare to identify unique visitors to our site and act as a counter for ongoing monitoring of site, email and corresponding future transaction activity related to a specific offer. These commonly used counters never collect personally identifiable information.
To provide you with the most rewarding experience, we may send your non-personally identifiable information to data processors so that they can validate and standardize your address to ensure that it is accurate and up-to-date. We may also seek out information about you that is publicly available on the open market and overlay this data with ours for comparison purposes. Information collected in this manner could include your spending habits from a mail-order catalogue, demographic information you provided in entering a sweepstakes, or your financial history.

By filling out the first page of our eCreditCare sign-up process, you agree to the terms of this privacy policy.
We collect personally identifiable information at the time of enrollment, including full name, date of birth, email and physical address and telephone number.
ECreditCare may also collect personally identifiable information from you through surveys, sweepstakes and other promotions. Participation in these offerings is optional, but you may be required to provide personally identifiable information (including name and address) to be eligible.
We may use "cookies" to ensure that only you can access your account. We also review "log-file" data to monitor site performance and analyze traffic patterns and usage of our site.
We occasionally send the information we gather about our eCreditCare members to third-party data processors to organize, process and/or analyze our data on our behalf to help us understand more about member participation in our programs and services. We use this information for the sole purpose of enhancing the offerings of our service; namely to tailor advertisements, updates, and other offers to your particular interests.
We share certain data with our advertisers in aggregate form, but eCreditCare services and programs are designed to ensure that you are not identified personally to advertisers unless you make the choice to share your personally identifiable information directly with them.
We may keep all information collected in accordance with this privacy policy indefinitely.
ECreditCare reserves the right to release information to local, state, or federal law enforcement officials when we believe in good faith that the law requires it, or when required to do so by order of a court or authorized administrative agency.
Please be aware that eCreditCare may amend this policy at our sole discretion. Upon any change to this policy, eCreditCare will notify you on our home page.
Our customer service representatives may contact you in response to an inquiry you submit. Our customer service representatives may also contact you with regard to a particular problem with your account. Security We maintain rigorous security practices to ensure as much as is commercially reasonable that the confidentiality of your personally identifiable information is not compromised.
We use commercially reasonable efforts to ensure the security for any credit card purchases made through participation in our program. What we don't do ECreditCare does not rent or sell your personally identifiable information to anyone without your express permission.
We do not collect or use any information about you for marketing purposes, except for information that you have provided to us or authorize us to obtain, or is publicly available, and this information is used solely to make our programs and services more relevant to your interests.
We do not accept enrollment from persons under the age of eighteen. The site will automatically block enrollment of any person once they indicate they are under the age of eighteen. If we later learn that a user is under the age of eighteen, we will terminate the account and delete the user's information. Inherent in the program is the responsibility of parents and/or guardians to ensure that their children's privacy is protected.
We will not be liable for any content or advertisements viewed by minor children in violation of the terms of this agreement.

ECreditCare is a credit management services company specializing in credit repair, management, and financial services.
The credit services offered to our members may include services relating to or constituting any or all of the following: personal credit information, credit education, and complete credit management and restoration and debt services. Cross promotion with various financial institutions and e-partners may provide members with access to credit cards, auto loans, auto leases, mortgages, student loans and other comprehensive loan programs on possibly more favorable terms than may be available prior to receiving the benefits of eCreditCare complete credit management and restoration service. However, eCreditCare cannot promise that you will obtain any new credit, such as a credit card, auto loan, auto lease, mortgage, student loan or other loan programs as a result of eCreditCare services.
While we feel that you are more likely to obtain such credit if we are successful in improving your credit rating through our complete credit management and restoration service, the ultimate credit decision remains with the lender or credit grantor, and we cannot control that process in any way.

ECreditCare membership |
|
Membership provides access to all the financial services, informational programs and products provided by eCreditCare. In addition to membership benefits, eCreditCare provides credit repair services to its members. There may be additional charges and or service fees charged for other elective associated financial services. Please refer to the services section of this agreement and our website for more detailed information.
Member agrees to provide eCreditCare necessary personal information as required by the credit reporting agencies and further agrees to execute the grant of limited power of attorney (see below) to eCreditCare for the purpose of performing its obligations hereunder, including to obtain member's credit reports and disputing inaccurate, outdated or unverifiable information. Member waives his or her right to privacy of the information provided and empowers eCreditCare to correspond directly with the three major credit reporting agencies or any sub agencies operating in smaller rural areas in the member’s name to order the credit profiles and dispute information therein. The original profiles stored by the various credit reporting agencies may be given directly to the member by the credit-reporting agency. Member agrees to mail all credit profiles or correspondence received by such member within five business days of receipt by member to eCreditCare for review and processing.
Please understand that no one, including eCreditCare or any other credit repair service, can remove accurate and current information from your consumer credit profile. Information can be removed from a person’s credit profile only if the credit history is inaccurate or obsolete and is not claimed to be accurate by the creditor who submitted the information to the credit bureau. ECreditCare will seek to have any inaccurate information corrected and, if appropriate, removed by the credit bureaus if and to the extent required under applicable federal and state laws, in accordance with the fair credit reporting act.

ECreditCare credit repair services |
|
ECreditCare will order your credit reports, analyze it to determine inaccurate, outdated and unverifiable information, ask you to confirm which items are to be disputed, and send a dispute letter to each of the three consumer credit reporting agencies (TransUnion, Experian and Equifax), disputing such information so that the credit reporting agency will either provide verification of such information, correct such information if it is inaccurate, or remove it according to the fair credit reporting act. Each dispute letter will be limited in the number of disputed items as eCreditCare determines is advisable. However, if there are more than two items (this number is subject to change based on eCreditCare’s discretion of the effectiveness of such letters) which can be properly and lawfully disputed, eCreditCare will send out multiple letters to each of the credit reporting agencies. You will receive a response directly from the consumer credit reporting agencies, which may contain a revised credit report, as well as various statements of your rights. You agree that promptly upon receipt of any correspondence from a consumer credit reporting agency, you will forward a copy of such correspondence to eCreditCare for further processing.
An eCreditCare membership is for six (6) months; we estimate that it will take approximately six months to complete the credit repair process. We cannot guarantee this. The actual amount of time required to complete this process will depend greatly on the number of items, which can be properly and lawfully disputed, and how promptly you forward correspondence from the credit reporting agencies to, eCreditCare. If after six months your credit profile requires additional work as determined by you, you may elect to enter into an additional 6-month membership with, eCreditCare. Unless you renew your membership after six months, we will not provide any additional services for you after six months. You are under no obligation to do so and renewal of your eCreditCare membership is entirely up to you. There is no set-up or other fee for renewal. We do not guaranty the results of our credit repair services. Please see our refund policy for additional information.

ECreditCare program |
|
ECreditCare and its predecessors have offered several programs to their respective members. While the program you are enrolled under or are contemplating enrolling under may differ from others, the description of how your particular program works and how eCreditCare will bill you for services can be found below.
ECreditCare program as of January 1, 2003
ECreditCare now offers just one program – the 2495 plan. We have found that it represents an evolution of eCreditCare services that best suit the majority of individuals enrolling in or contemplating enrollment in the eCreditCare program.
The 2495 plan. There is no base monthly membership fee under the 2495 plan. Membership will provide access to all the financial services, informational programs and products provided by eCreditCare, other than credit repair services. In addition to membership benefits, eCreditCare provides credit repair services to its members. There may be additional charges and or service fees charged for other elective associated financial services. Please refer to the services section of this agreement and our website for more detailed information. Credit repair services (as described below) are charged for the actual work provided by eCreditCare.
Accordingly, eCreditCare will charge you $24.95 per disputed item that we dispute on your credit report. You will not be charged an additional fee for any items deleted. See below for more details on this fee.
All charges for eCreditCare services will be automatically charged to your credit card or bankcard that you specified upon enrollment. In the event eCreditCare discovers that services were provided but not billed, eCreditCare shall have the right to charge such fees at any time after such discovery. Any form of payment that you submit or provided with membership can be charged for services rendered by eCreditCare. If any form of payment you supply is uncollectible for any reason, eCreditCare may charge you a dishonored payment fee of the lesser of $25.00 or the maximum rate permitted by applicable law. Your 2495 plan membership may be cancelled at any time upon receipt by eCreditCare of written notice of cancellation. If you cancel your membership at any time within five days following your purchase of a membership, we will refund everything you have paid within 15 days. This means that you, the buyer, may cancel this contract at any time prior to midnight of the fifth day after the date of your initial signup for credit repair services, for any reason or no reason, with no liability for any charges of any kind. See the attached notice of cancellation form for an explanation of this right.
Fees and charges for 2495 plan members: the fees for each dispute sent on your behalf are $24.95 per item disputed per credit reporting agency. This fee shall be payable upon the issuance of such dispute by eCreditCare (the “dispute date”). You agree to send to eCreditCare a copy of any credit report you receive while a member of eCreditCare or within the three months following termination or cancellation of your membership for any reason.
For 2495 plan members, if you do not send a copy of a credit report sent to you by any credit reporting agency or bureau within 60 days after a dispute letter is sent to such credit reporting agency or bureau by eCreditCare, eCreditCare will deem that you have received such credit report and failed to send it to eCreditCare within the required five day period, and eCreditCare may order a new credit report for you. Your permission is hereby given to order the credit reports. ECreditCare reserves the right to use a bureau-approved merchant to expedite the ordering of your credit reports. ECreditCare may use the information in the updated credit report to determine which previously disputed items were deleted, corrected or otherwise updated. If there are additional items that eCreditCare determines should be disputed, eCreditCare may dispute such items and charge you accordingly.
Estimate of total charges. How much you are charged for all services rendered by eCreditCare, including credit restoration and repair services, depends on how many inaccurate, unverifiable and/or outdated items appear on each of the three main consumer credit reports provided by the consumer credit reporting agencies, as well as your response to our request that you view your credit report and determine what items are to be disputed. In most circumstances, we believe that as a result of eCreditCare’s credit repair services, most inaccurate, unverifiable and/or outdated items will be either corrected or removed from your credit reports within six months. We believe that the average person has eighteen (18) inaccurate items on their credit reports (6 for each of the three primary credit-reporting agencies). If six inaccurate, unverifiable or outdated items are disputed on each of your three credit reports, you will have paid to eCreditCare a total of $143.10 ($24.95 x 6 x 3 = $449.10). If you have more than six items that eCreditCare disputes on each of your credit reports, this amount will be higher. In any event, we will not charge you more than a maximum of $1295.00 for our credit repair services, even if we send more than 100 disputes on your behalf. For people with many more inaccurate, unverifiable or outdated items on their credit reports, the total charges can be as high as the $1295.00 maximum charge. However, you can always cancel your membership, but all fees earned prior to such cancellation will be due and payable to eCreditCare according to this agreement. Please be sure you clearly understand, however, that no one, including eCreditCare or any other credit repair service, can remove accurate and current information from your consumer credit profile. If, upon your review of your credit report, you note that there are derogatory but accurate items on your credit report that we have disputed, you agree that you shall promptly notify eCreditCare of this oversight so that eCreditCare can rescind that dispute. You may not make, and we may not make on your behalf, any untrue or misleading statement to a consumer credit reporting agency. In order to prevent this, we need you to notify us of any adverse information on your credit report that is, in fact, accurate, so that we can be sure not to dispute such item. You agree that when you receive our email advising you that your credit report is available for viewing, you will promptly review the credit report and inform us which items you want disputed, and which items you do not want disputed. You agree that you will not ask us to dispute anything that you know to be accurate or not outdated.

Billing |
|
Your initiation fee (if any), membership fee (if any), dispute fees (if any), deletion fees (if any) and any elective fees or charges will be automatically charged to the credit card or bank card or account that you specified. In the event eCreditCare discovers that services were provided but not billed, eCreditCare shall have the right to charge such fees at any time after such discovery. Any form of payment that you submit or provided with membership can be charged for fees and services rendered by eCreditCare. If any form of payment you supply is uncollectible for any reason, eCreditCare may charge you a dishonored payment fee of the lesser of $25.00 or the maximum rate permitted by applicable law. From time to time, eCreditCare may extend special offers that may waive certain fees. To verify billing information and to protect against fraudulent use of your personal account information, eCreditCare may assess an authorization of $50.00 to the account you provide for billing. If you cancel under the terms of the five day cooling off period, this authorization will expire, and any fees actually charged will be refunded.
To assist eCreditCare in properly assessing any accrued fees due, you agree to send to eCreditCare a copy of any credit report you receive while a member of eCreditCare or within the three months following termination or cancellation of your membership for any reason, within five business days of your receipt of such report.
Payment for the eCreditCare services provided to you are made by automatic credit card or debit card debit, or by “e-checks” and you hereby authorize eCreditCare’s authorized payment processing agent to transact such payments on your behalf. You agree not to report as lost or stolen any credit card which you have used in conjunction with payment to eCreditCare, or as unauthorized any charge by eCreditCare, for any services for which you do not have good reason to believe is, in fact, lost, stolen or unauthorized. You hereby agree that any such fraudulent reporting, including but not limited to “chargeback” requests, of a lost or stolen credit card used to pay for eCreditCare services, or any fraudulent reporting of an unauthorized charge by eCreditCare on your credit card which has been made by you or anyone under your authority, at a time when a charge or other obligation for payment for goods and/or services to the website remains outstanding at the time of such fraudulent reporting, you shall be liable to eCreditCare for liquidated damages of the lesser of the maximum liquidated damages permitted by law in this event, or $1,500.00. The liability for liquidated damages specified in this paragraph shall not limit any other liability you may have for breach(es) of any other terms, conditions, promises and warranties set forth in this agreement. You agree and acknowledge that this liquidated damages provision is reasonable in light of the fact that false accusations of fraudulent charges on a credit card impair eCreditCare’s reputation and standing with its banks, payment processors and other service providers, and that unjustified chargeback’s are costly to eCreditCare.
Member acknowledges eCreditCare must and does adhere to the federal fair credit reporting act and the California revised statutes title 1.6. Consumer credit reporting agencies act- civil code section 1785.1-1785.6, inclusive. ECreditCare is also subject to the provisions of the California credit services organization act, appearing at California civil code section 1789.10, et. Seq. As stated therein, if eCreditCare violates the provisions of that act, you may seek damages from eCreditCare and the issuer of the bond maintained by eCreditCare and filed with the California secretary of state, as required by the act. See California civil code section 1789.18 for a more detailed description of the circumstances under which you can proceed against the bond. Any person claiming against the bond for a violation of the act may maintain an action at law against us and against the surety (the issuer of our bond). The surety shall be liable only for actual damages. If you need to serve us with process, the name and address of our agent for service of process is: Paule b. Joubran, 12169 Kirk ham road, Poway, California 92064. This is our principal business address as well.
In performing services for its members, eCreditCare seeks to have the credit bureaus and others who disseminate credit information adhere to the federal fair credit reporting act. ECreditCare, or any other entity, cannot guarantee the credit bureaus will correct, update or, if appropriate, remove or delete, adverse credit information, which is accurate and not obsolete. In an effort to avoid inadvertently disputing accurate information, you agree to inform eCreditCare of any negative information on your credit report which is accurate and should not be disputed. You may inform eCreditCare of such information by sending email to service@eCreditCare.com, or sending a letter to eCreditCare customer service, at 12169 Kirk ham road, Poway, California 92064. In addition, when your report is posted to your account, you will be sent an email notifying you that it is available for your review, and you will be requested to promptly review the report and identify which items are accurate or inaccurate, outdated or current, and accordingly which items you want us to dispute or not dispute. You agree that when you receive our email advising you that your credit report is available for viewing, you will promptly review the credit report and inform us which items you want disputed, and which items you do not want disputed. You agree that you will not ask us to dispute anything that you know to be accurate or not outdated.

Cancellation and refunds |
|
Your membership may be cancelled at any time by sending a written notice of cancellation. All fees are non-refundable, unless you cancel your membership within five (5) days of your initial signup as stated below. You agree to pay any accrued, unbilled charges to your account through the date of cancellation at the time of cancellation, so long as you have not cancelled within five days of your initial signup or any renewal.
The only exception to our non-refund policy is if you provide written cancellation of your membership and we receive it prior to the expiration of your five-day cooling off period. If you cancel your membership at any time within five days following your purchase of a membership (or your renewal of a membership), within 15 days we will issue a refund for all fees you have paid during the membership that was cancelled. This means that you, the buyer, may cancel this contract at any time prior to midnight of the fifth day after the date of your purchase or renewal of a membership, for any reason or no reason, without any liability for any charges during that membership. See the notice of cancellation form for an explanation of this right.
To assist eCreditCare in properly assessing any accrued fees due, you agree to send to eCreditCare a copy of any credit report you receive while a member of eCreditCare or within the three months following termination or cancellation of your membership for any reason, within five business days of your receipt of such report

Grant of limited power of attorney: |
|
Member empowers eCreditCare, its employees, agents, subcontractors and assignees to perform or engage in any act on behalf of member related to inaccurate, unverifiable or outdated information contained in member’s personal credit profile, including, without limitation, the right to obtain the member’s credit reports and profiles from credit reporting agencies and credit bureaus.
The specific acts necessary to accomplish the purpose of this agreement shall be at the sole discretion of eCreditCare’s professional judgment. The specific acts shall require periodic ordering of member’s consumer credit reports by eCreditCare. The specific acts may include written and oral communications in your name regarding disputes and negotiations with various agencies and entities disseminating credit data concerning member. The various agencies and entities include but are not limited to, credit reporting agencies, credit bureaus, creditors and collection agencies. Member authorizes eCreditCare to order member’s consumer credit reports from time to time. Member hereby directs and authorizes eCreditCare to verify and dispute all negative credit items, including inquiries, and those items determined by eCreditCare to potentially have a negative impact on member’s credit rating, including disputes made for the purpose of determining whether the information is verifiable. Member can elect to notify eCreditCare of specific accounts for dispute if verification requests do not result in the removal of inaccurate, outdated or unverifiable item(s). Member specifically waives his or her right to privacy regarding those communications between eCreditCare, and the various agencies and entities disseminating credit data regarding member.
After you sign up for our credit repair service, we will analyze your credit report to determine what items are negative or derogatory. Because the fair credit reporting act requires credit reporting agencies to update, correct or, if appropriate, remove, inaccurate, obsolete or unverifiable information in a consumer's credit report, you authorize us to dispute and/or request verification for any and all negative or derogatory information. If there is any derogatory information you feel is accurate and not obsolete, and you do not want us ask the credit reporting agencies to attempt to verify the information, please inform us by sending an email to us within five days of your initial sign-up.
Member further gives and grants to eCreditCare, full power and authority to do and perform every act necessary and proper in the exercise of any of the powers granted hereunder as fully as member might or would do if personally present, with full power of substitution and revocation, hereby ratifying and confirming all that said attorney in fact shall lawfully do or cause to be done by virtue hereof.
From time to time, credit reporting agencies may refuse to honor the provisions of the above grant of a power of attorney, and will therefore send a letter to you stating that they will not honor the dispute letter sent on your behalf by eCreditCare. While eCreditCare believes that this action by the credit reporting agencies is a violation of the provisions of the fair credit reporting act, in such case, you are encouraged to print out the power of attorney available on eCreditCare's website, and provide to eCreditCare a notarized or acknowledged executed original power of attorney. ECreditCare believes that the credit reporting agencies are more likely to honor the power of attorney in such case, and will then comply with their obligations under the fair credit reporting act.

You acknowledge that eCreditCare must and does adhere to the federal fair credit reporting act and the California revised statutes title 1.6. Consumer credit reporting agencies act- civil code section 1785.1-1785.6, inclusive. In performing services for its members, eCreditCare seeks to have the credit bureaus and others who disseminate credit information adhere to the federal fair credit reporting act. ECreditCare, or any other entity, cannot guarantee or promise that the credit bureaus will update, remove or delete adverse credit information, which is accurate and not obsolete. Please be sure you clearly understand that no one, including eCreditCare or any other credit repair service, can remove accurate and current information from your consumer credit profile. If, upon your review of your credit report, you note that there are derogatory but accurate items on your credit report that we have disputed, you agree that you shall promptly notify eCreditCare of this oversight so that eCreditCare can rescind that dispute. You may not make, and we may not make on your behalf, any untrue or misleading statement to a consumer credit reporting agency. In order to prevent inadvertently disputing accurate information, you agree to inform eCreditCare within five days following the date you purchase your membership of any negative information on your credit report which is accurate and should not be disputed. You may inform eCreditCare of such information by sending email to support@eCreditCare.com, or sending a letter to eCreditCare customer service, at 12169 Kirk ham road, Poway, California 92064. |
Final digital signature: the federal e-sign act (hr-1714): |

The e-sign act grants electronic signatures and documents equivalent legal status as traditional handwritten signatures. By completing our online membership agreement, you are certifying that your digital signature is the equivalent of your handwritten signature. Furthermore, you agree that you have read all of the agreement and are agreeing to and signing each section of this membership agreement with your digital signature. You further agree that you understand the agreement and have read "your rights as a consumer".
ECreditCare does not guarantee a success rate. Our methods are based upon procedures that have been found to have a high success rate. The length of time necessary to complete credit restoration and management program varies from member to member. The typical amount of time necessary to complete the credit restoration and management program is six (6) months. The term of this agreement is six months, and shall terminate after such time. You may, at your sole discretion, renew your membership after six months for an additional six months. For your convenience, all memberships will be automatically renewed for an additional six months upon expiration, unless you notify us that you desire not to renew your membership. Any such renewal will be deemed a new purchase of a membership under the terms of this agreement, and you will then have the same cancellation and refund rights described herein that apply to any new member. To clarify, this means that if your membership is renewed, you will then have the right to receive a full refund of any fees charged during the new membership if you cancel that renewed membership, or any reason or no reason, within five days of the renewal. ECreditCare is not liable for any changes in your credit profile, which have an adverse affect on your credit rating. ECreditCare is not liable for the actions of any companies in partnership with, or which provide services at the request of, eCreditCare.

Hold harmless |

You hereby agree to indemnify, defend and hold eCreditCare and all its officers, directors, owners, agents, employees, information providers, affiliates, licensors and licensees (collectively, the "indemnified parties") harmless from and against any and all liability and costs incurred by the indemnified parties in connection with any claim arising out of any breach by you of these terms of use or the foregoing representations, warranties and covenants. You shall cooperate as fully as reasonably required in the defense of any claim. ECreditCare reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and you shall not in any event settle any matter without the written consent of eCreditCare.
This agreement shall be subject to and construed in accordance with the laws of the state of California, excluding its conflict of law principals. If you need to serve us with process, the name and address of our agent for service of process is: Paule b. Joubran, 12169 Kirk ham road, Poway, California 92064. This is our principal business address as well. Any dispute arising hereunder shall be resolved by binding arbitration under the American arbitration commercial arbitration rules. To the extent permitted by applicable law, any liability of eCreditCare hereunder shall be limited to the actual membership fees and charges paid by the member. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law, the remainder of this agreement shall continue in effect. Notwithstanding any other provision in this or any other agreement between the parties, the provisions of this agreement shall prevail in the event of any conflict, and all non-conflicting terms and conditions contained in any other such agreement are incorporated herein by this reference.

All such information is provided "as is" without warranty of any kind. ECreditCare and its affiliates hereby disclaim all warranties and conditions with regard to this information, including all warranties and conditions of merchantability, whether express, implied or statutory, fitness for a particular purpose, title and non-infringement. In no event shall eCreditCare or its affiliates be liable for any special, indirect or consequential damages (or, with respect to use of information contained on eCreditCare’s or its affiliate’s websites, any damages whatsoever), including those resulting from delay, inaccurate information or data, loss of use, data or profits, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with the use or performance of information contained in eCreditCare’s or its affiliates websites, or from eCreditCare’s providing the services hereunder.
ECreditCare does not guarantee a success rate. Our methods are based upon procedures that have been found to have a high success rate. The length of time necessary to complete credit restoration and management program varies from member to member. The typical amount of time necessary to complete the credit restoration and management program is six (6) months. The term of this agreement is six months, and shall terminate after such time. You may, at your sole discretion, renew your membership after six months for an additional six months. For your convenience, all memberships will be automatically renewed for an additional six months upon expiration, unless you notify us that you desire not to renew your membership. Any such renewal will be deemed a new purchase of a membership under the terms of this agreement, and you will then have the same cancellation and refund rights described herein that apply to any new member.
